| dc.description.abstract | การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาปัจจัยที่นำไปสู่การใช้แรงงานเด็กขายพวงมาลัยในเวลากลางคืน ในพื้นที่อำเภอเกาะสมุย จังหวัดสุราษฎร์ธานี (2) วิเคราะห์กฎหมายและมาตรการคุ้มครองแรงงานเด็กในประเทศไทย และ (3) หามาตรการคุ้มครองการใช้แรงงานเด็กขายพวงมาลัยในเวลากลางคืน ในพื้นที่อำเภอเกาะสมุย จังหวัดสุราษฎร์ธานี การวิจัยใช้ระเบียบวิธีเชิงคุณภาพ โดยอาศัยการวิเคราะห์เอกสารและการสังเกตทั้งแบบมีส่วนร่วมและไม่มีส่วนร่วม โดยกลุ่มเป้าหมายในการศึกษาคือ แรงงานเด็กขายพวงมาลัยในเวลากลางคืนในพื้นที่อำเภอเกาะสมุย ผลการศึกษาพบว่า ปัจจัยสำคัญที่ส่งผลต่อการใช้แรงงานเด็กขายพวงมาลัยในเวลากลางคืนในพื้นที่อำเภอเกาะสมุย จังหวัดสุราษฎร์ธานี ประกอบด้วย 5 ปัจจัย ดังนี้ 1) ปัจจัยทางเศรษฐกิจและความเปราะบางของครอบครัว 2) ปัจจัยเชิงโครงสร้างทางสังคมและการขาดระบบคุ้มครองทางสังคมที่มีประสิทธิภาพ 3) ปัจจัยด้านการศึกษาและโอกาสในการพัฒนาศักยภาพ 4) ปัจจัยด้านพื้นที่และสภาพแวดล้อมในการทำงาน และ 5) ปัจจัยด้านการกำกับดูแลและบทบาทของครอบครัว เกิดปัญหากฎหมายการใช้แรงงานเด็กและกฎหมายคุ้มครองเด็กไม่เต็มประสิทธิภาพ ทำให้เด็กยังคงถูกใช้แรงงานผิดกฎหมายและมาตรการคุ้มครองแรงงานเด็กที่ส่งผลต่อการทำให้เกิดปัญหาการใช้แรงงานเด็กขายพวงมาลัยในเวลากลางคืนในพื้นที่อำเภอเกาะสมุย เนื่องจากข้อบัญญัติและกฎหมายท้องถิ่นที่ขาดบทบาทและอำนาจหน้าที่ที่ชัดเจนในการตรวจสอบและบังคับใช้กฎหมายเกี่ยวกับการคุ้มครองแรงงานเด็ก ในพื้นที่ เกาะสมุย เกิดช่องว่าของการบังคับใช้ข้อบัญญัติและกฎหมายมิ้งถิ่นที่ไม่สามารถคุ้มครองเด็กในพื้นที่เฉพาะได้อย่างมีประสิทธิภาพ ผู้วิจัยได้เสนอมาตรการคุ้มครองการใช้แรงงานเด็กขายพวงมาลัยในเวลากลางคืนสำหรับพื้นที่อำเภอเกาะสมุย จังหวัดสุราษฎร์ธานี เพื่อแก้ไขปัญหาการบังคับใช้กฎหมายท้องถิ่น ซึ่งประกอบด้วย 3 มาตรการหลัก คือ มาตรการคุ้มครองทางกฎหมายเฉพาะสำหรับการขายพวงมาลัยในเวลากลางคืน มาตรการสนับสนุนด้านเศรษฐกิจและสังคม และมาตรการด้านการศึกษาและการพัฒนาทักษะสำหรับเด็ก | en_US |
| dc.description.sponsorship | This study aims to (1) examine the factors contributing to the use of child labor in nighttime garland selling in Koh Samui District, Surat Thani Province, (2) analyze relevant laws and child labor protection measures in Thailand, and (3) propose appropriate protective measures for children engaged in garland selling at night in the study area. A qualitative research methodology was employed, utilizing document analysis and both participatory and non-participatory observation. The target group consisted of child laborers engaged in nighttime garland selling in Koh Samui District. The findings reveal five key factors influencing the persistence of child labor in this context: (1) economic hardship and household vulnerability, (2) structural social factors and the absence of an effective social protection system, (3) limited access to education and capacity development opportunities, (4) environmental and spatial working conditions, and (5) family supervision and governance. The study further identifies legal gaps, particularly the insufficient enforcement of child labor and child protection laws, as well as the lack of clarity and authority in local regulations, which hinder effective protection of children in Koh Samui. To address these issues, the study proposes three major protective measures tailored to the local context: (1) the development of specific legal frameworks regulating nighttime garland selling by children, (2) economic and social support measures for vulnerable families, and (3) educational and skill-development initiatives for affected children. | en_US |
